With the abuse of the Guantanamo detainees why hasn't president Bush been charged with war crimes?

If other countries had treated POW's in the way that these people have been treated we would have been outraged by the lack of justice being served. i think of our Military all over the world and think that if other countries see how we treat the POW's in our care that maybe they will take it out on our soldiers
